Giving approval to the Maternity Benefit (Amendment) Act, 2017, President Pranab Mukherjee on March 29 signed the amendment, thus officially making it into a law.
Under this new law, women employees will now be able to avail paid maternity leave of 26 weeks as compared to just 12 weeks earlier.
The new law also entitles certain other benefits to women employees, such as it is now mandatory for every establishment, with fifty or more employees, to have a creche within a prescribed distance.
Women employees would also be allowed four visits a day to the creche by law.
The new act had made changes in some of the provisions of the Maternity law which was over 55-year-old.
With these changes now in place, every establishment is now bound to intimate every woman employee regarding the benefits she will get under this new law that too in writing and/or electronically.
All these written intimations have to be given to the women employees at the time of their initial appointment under the new statute.
The new law also allows maternity leave of up to 12 weeks for a woman who adopts a child below the age of three months.
Though women must note that the entitlement of 26 weeks paid maternity leave is only allowed for the first two children. Form third child a woman will only be entitled to 12 weeks of maternity leave.
The law will apply to every establishment that has 10 or more people working under them.
