In the past decade or so India has gone through many ups and downs with regards to the Laws with many changes taking place.
These changes not only ensures smooth functioning of the country but also to keeps us up-to-date with the changing time, need and requirements.
Good and sound laws are integral to smooth conduct in any organisation and while they are there to help and protect the people, it’s also our responsibility as a citizen to know that our rights are.
Unfortunately, that is where the majority of us falter as we are unaware of exactly is the protocol and what can and cannot be done.
While a layman cannot fully know the complex laws and rights of the Constitution here are few things that we think everyone needs to know so one is not be exploited because he/she is unaware.
#1 You can use the washrooms of any hotel for free and can ask them for drinking water at any time.
Under Indian Sarais Act, 1867, any individual can demand free washroom facility and be drinking water for themselves and their pets at any hotel in India.
#2 A woman cannot be arrested after sunset and before sunrise unless specified.
While this law has been repeated to people time and again, we believe it still is not known by the majority of the population.
Under Supreme Court’s ruling, women cannot be arrested after sunset and before sunrise unless police have a written document as a proof of why they require the woman arrested at that time.
#3 Women offenders can only be arrested by women officers and that too only between 6 a.m. to 6 p.m.
#4 A woman can lodge an FIR at any police station, irrespective of the place of crime.
The Indian government is going all out to make sure that woman feel protected and safe at all times and that they feel secure to approach the police at any time.
#5 Women can file a complaint via an email or registered post to the Deputy Commissioner or Commissioner of Police.
What’s more, the Delhi Police made sure that if a woman is unable to go to the police station then she can use the above-stated method to lodge her complaint and get her grievances addressed.
#6 Pregnant women cannot be fired from their jobs.
While recent changes in law by the Women Ministry have added more benefits for new mothers, one must also know that under Maternity Benefit Act 1961, a woman who is pregnant cannot be fired from her job for any reason.
#7 Kissing or hugging in public is not a criminal offence.
For all the people who try moral police people without actually knowing the law, please note that under Section 294 of the Indian Penal Code, it is clearly stated that “obscenity” in public is a crime, but there is no hint towards kissing or hugging.
#8 The law does not state that unmarried couples can be denied rooms in hotels.
Adding to above, we must also point out that the Hotel Association of India (HAI) has again clearly stated that there is no such rule that denies unmarried couples rooms in hotels in any part of the country.
#9 Live-in relationships are not illegal.
Coming to the last point, again it’s a statement which is preached mostly by “moral police” who have no idea about the law.
Under Supreme court’s guidelines, Live-in relationship is not a crime and rather the children born out of live-in relationships have the right to claim on their parents’ property.
